3. How to apply for exemption and suspension

How to get an exemption

Continuing education is a compulsory course for nursing assistants, and if you do not report it during the qualification reporting period, you may receive a separate administrative disposition. In that case, the first round ends with a warning, but the second round can result in a one-week suspension. Is there any way to get an exemption?

If you meet the conditions below, you are considered eligible for continuing education exemption.

New qualification holders who were issued a license in the current year
Students enrolled in a university or junior college majoring in nursing in accordance with Article 7 Subparagraph 1 of the Medical Act for more than one semester
A person who is recognized by the Minister of Health and Welfare as not necessary to receive refresher education
A person who has received refresher education related to the license in a foreign country
If you gave birth while working
Those who gave birth after resignation
who retired after giving birth
Military service for more than 6 months (general and medical)
The difference between probation and waiver

If exemption means that you don’t have to go through continuing education, then probation is the concept of postponement. The conditions for grace are as follows.

Those who were not engaged in work related to the qualification in the relevant year
A person whom the Minister of Health and Welfare recognizes as having difficulty in continuing education due to illness or other unavoidable reasons
If either of these apply

If you are eligible for exemption or postponement, you can apply by submitting relevant documents through the Qualification Report Center of the Korean Nursing Assistants Association. Detailed evidence and application methods can be found through the Korean Association of Nursing Assistants.

4. What if I don’t receive it?

Disadvantages of not receiving

As I explained earlier, I said that for nursing assistants, refresher education is a kind of renewal process that allows them to maintain their qualifications, so it is mandatory. If you do not receive this intentionally or due to personal circumstances, the disadvantages are as follows.

1st Violation: Warning

2nd Violation: Administrative disposition of suspension of qualifications for 7 days

Legal basis for completion of continuing education

Necessary matters related to the national examination and qualification recognition of nursing assistants pursuant to Article 80, Paragraph 1 of the Medical Act, the designation and evaluation of nursing assistant education and training institutions pursuant to Paragraph 2, the qualification report and supplementary education of nursing assistants pursuant to Paragraph 4, etc. is stipulated by the Ordinance of the Ministry of Health and Welfare.
